1. Subject Matter
These general terms and conditions of sale (the “General Terms and Conditions of Sale”) govern the relationship between GIOIELLERIA TALARICO di Maria Teresa Talarico, with registered office in Via Grande, 180 – 57123 LIVORNO (LI), VAT No. IT02092480496, Tax Code TLRMTR49A51E625E, registered with the Livorno Companies Register No. REA LI-236022, and the Customer (as defined below) in relation to purchases made remotely via the website www.gioielleriatalarico.it
of Products (as defined below), and are intended to exclusively regulate B2B relationships.
For any matter not expressly governed by these General Terms and Conditions of Sale, reference is made to the provisions of the Italian Civil Code.
2. Definitions
In these General Terms and Conditions of Sale, the following terms shall have the meanings specified below:
“Customer”: means a “private customer” or a “commercial/professional operator.”
“Parties”: means jointly GIOIELLERIA TALARICO and the Customer.
“Products”: means watches, jewelry, silverware “on consignment from private individuals” or items described under the section “Il Nuovo” (The New) of Gioielleria Talarico, included in the virtual catalog published on the Website and marketed by GIOIELLERIA TALARICO, as illustrated in the relevant descriptive and technical sheets.
“Website”: means the website corresponding to the address www.gioielleriatalarico.it
3. Acceptance of the General Terms and Conditions of Sale
These General Terms and Conditions of Sale must be examined by the Customer before completing the purchase procedure indicated on the Website.
Submitting an order confirmation implies acceptance of the specific purchase conditions (Products ordered, purchase price, etc.), as well as full knowledge and unconditional acceptance of these General Terms and Conditions of Sale.
4. Purchase Procedure and Conclusion of the Contract
Customers wishing to purchase Products online must first register by following the procedure described on the Website in order to activate the process for submitting an online purchase proposal.
For catalog items listed as “On consignment from private individuals,” upon sale a personalized tax receipt will be issued including the buyer’s name, tax code, and identification document (driver’s license, ID card, passport).
For catalog items described in the “Il Nuovo” section, a tax receipt or invoice will be issued upon sale.
Items “On consignment from private individuals” are used and may show normal signs of wear.
Purchase proposals must be submitted electronically to GIOIELLERIA TALARICO according to the procedure described on the Website, specifying the product code and quantity.
Following submission of the purchase proposal, the Customer will receive communication regarding actual product availability and, if available, confirmation of acceptance by email to the address provided. This email will include:
a summary of available Products
unit price of each selected Product
total transaction amount
shipping costs
delivery time
an order number to be used as reference for future communications
The online sales contract is considered concluded and binding when GIOIELLERIA TALARICO sends the acceptance confirmation email.
GIOIELLERIA TALARICO reserves the right not to accept incomplete or improperly filled purchase orders.
5. Minimum Order
The minimum order amount must be €50.00 (fifty/00), VAT excluded.
GIOIELLERIA TALARICO reserves the right not to accept orders below this amount.
6. Products
The Products governed by these General Terms and Conditions of Sale are those included in the catalog published on the Website, accessible only to registered Customers.
Each Product listing includes the price and the relevant technical sheet.
GIOIELLERIA TALARICO reserves the right to modify the online catalog at any time.
7. Sale Prices
Product prices are indicated on the Website, expressed in Euros, and exclude taxes and shipping costs, which will in any case be communicated to the Customer upon order confirmation.
GIOIELLERIA TALARICO reserves the right to modify prices at any time without notice.
8. Shipping and Delivery
GIOIELLERIA TALARICO will deliver the ordered Products to the address provided by the Customer via express courier.
Shipping costs are borne by the Customer.
For each shipment, GIOIELLERIA TALARICO will issue a personalized receipt and/or tax receipt or invoice, which will be included in each parcel.
GIOIELLERIA TALARICO undertakes to hand over available Products to the courier within 7 working days from the order confirmation.
GIOIELLERIA TALARICO shall not be liable for failure or delay in delivery due to courier responsibility, force majeure, or unforeseeable circumstances.
9. Product Warranty – Defects – Complaints
The Customer acknowledges that the online catalog consists of purely indicative photographic reproductions.
GIOIELLERIA TALARICO guarantees that delivered Products conform to their online technical descriptions.
Items “On consignment from private individuals” are used and may show normal signs of wear.
Upon delivery, the Customer must verify package integrity and absence of defects. Any damage or defects must be reported within 8 days of receipt via fax or registered mail with return receipt, clearly stating the reasons for complaint.
Complaints submitted after this deadline will not be considered.
Return shipping costs are borne by the Customer.
10. Payment Methods
Products must be paid for using one of the following methods selected at the time of order submission:
– Advance bank transfer. Bank details will be communicated upon order confirmation. Payment must be made within 5 (five) working days from receipt of order confirmation.
Delivery will occur after payment confirmation. In case of bank transfer, shipment will proceed upon receipt of funds in GIOIELLERIA TALARICO’s bank account.
Late or non-payment entitles GIOIELLERIA TALARICO not to process the order.
In case of non-payment, GIOIELLERIA TALARICO may terminate the contract and charge the Customer for incurred expenses (including shipping), without prejudice to compensation for damages.
11. Retention of Title
GIOIELLERIA TALARICO retains ownership of the delivered Products until full payment of the purchase price, expenses, taxes, and duties has been received.
12. Limitation of Liability
GIOIELLERIA TALARICO undertakes to ensure continuity of service, except in cases of technical issues, ordinary and/or extraordinary maintenance, force majeure, including decisions by Authorities.
If service must be interrupted due to security reasons, confidentiality concerns, exceptional events, or maintenance, GIOIELLERIA TALARICO will aim to minimize downtime.
GIOIELLERIA TALARICO declines all liability for temporary or permanent service interruptions, whether caused by itself or third parties, and does not guarantee service continuity, nor responsibility for partial or total data loss, or compensation for damages (including consequential damages and loss of profit).
The Customer acknowledges and accepts that order acquisition via the Website may be suspended during closure periods.
13. Applicable Law and Jurisdiction
These General Terms and Conditions of Sale are governed by Italian law.
Any dispute concerning execution, interpretation, or breach of these General Terms and Conditions of Sale and the online contract shall fall under the exclusive jurisdiction of the Court of Livorno.
